These Terms of Service ("Terms") govern your access to and use of Shadow in Motion (the "Service"), operated by Shadow in Motion ("we," "us," "our"), available at shadowinmotion.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Shadow in Motion is an online martial‑arts training platform that provides personalized curricula, instructional content and references, progress tracking, on‑camera testing tools, an AI‑assisted training guide, and community features. It is an educational and training aid — it is not a substitute for hands‑on instruction from a qualified in‑person instructor.
2. Eligibility & Accounts
- You must be at least 18 years old to create an account and purchase a membership. Minors may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on their behalf.
- You are responsible for the information you provide, for keeping your password confidential, and for all activity under your account.
- Notify us promptly of any unauthorized use of your account.
3. Membership, Free Trial, Billing & Cancellation
- Free trial. New members may receive a 7‑day free trial. You will not be charged during the trial if you cancel before it ends.
- Recurring billing. After the trial, your membership automatically renews on a recurring monthly basis at the then‑current price for your plan, charged through our payment processor, Stripe, until you cancel.
- Founding pricing. Promotional or "founding member" pricing, where offered, applies as described at sign‑up and remains in effect only while your membership stays continuously active.
- Cancellation. You may cancel at any time through the customer portal ("Membership" in the app). Cancellation stops future charges; your access continues until the end of the current billing period.
- Refunds. Except where required by law, payments are non‑refundable and we do not provide refunds or credits for partial billing periods. We may, at our sole discretion, offer a refund in individual cases.
- Price changes. We may change prices with reasonable notice; changes apply to billing periods after the notice.
4. Assumption of Risk & Health Disclaimer
Martial arts and physical training involve inherent risks, including the risk of serious injury. By using the Service you acknowledge and voluntarily accept these risks.
- Consult a physician before beginning any exercise or martial‑arts program, especially if you have any medical condition, injury, or concern. Stop and seek medical attention if you feel pain, dizziness, or discomfort.
- You are solely responsible for training safely, within your ability, in a safe environment, and using appropriate equipment and supervision.
- To the fullest extent permitted by law, you assume all risk of injury or loss arising from your participation, and you release Shadow in Motion from any liability for injuries or harm resulting from your use of the Service or performance of any technique, drill, or exercise.
5. Community & In‑Person Meetups
Meetups and member connections are organized entirely by users — not by Shadow in Motion. We do not host, supervise, vet, background‑check, or endorse any member, group, organizer, or event.
- If you attend or organize an in‑person meetup, you do so at your own risk. Meet only in public places, never share your home address, tell someone where you'll be, and use good judgment about the people you meet.
- You are responsible for your own conduct and safety and for complying with all applicable laws during any in‑person activity.
- To the fullest extent permitted by law, Shadow in Motion is not responsible or liable for the actions, content, or conduct of any member, or for any injury, loss, or damage arising from member interactions or meetups.
6. Not Official Rank or Certification
Shadow in Motion is an independent training platform and is not affiliated with or endorsed by any martial‑arts federation, association, or governing body unless expressly stated. Progress, "readiness," testing results, or any training record produced by the Service are for your preparation and reference only and do not constitute an official belt, rank, grade, or certification. Official rank can only be awarded by a recognized instructor or organization through their own testing.
7. AI Assistant
The AI "digital sensei" is an automated tool that may produce inaccurate or incomplete information. It is provided as general guidance only and is not professional, medical, legal, or safety advice. The AI features use an API key that you supply and rely on third‑party AI providers; your use of them is subject to those providers' terms.
8. Acceptable Use
You agree not to:
- Post or share content that is unlawful, harassing, hateful, threatening, obscene, or that infringes others' rights;
- Impersonate others, share others' private information, or solicit or defraud members;
- Disrupt, attack, reverse‑engineer, or attempt to gain unauthorized access to the Service;
- Use the Service for any illegal purpose or to promote violence.
We may remove content and suspend or terminate accounts that violate these Terms, at our discretion.
9. User Content & Intellectual Property
- You retain ownership of content you submit (posts, messages, submissions). You grant us a non‑exclusive, worldwide, royalty‑free license to host, display, and use that content to operate and improve the Service.
- The Service, including its curricula, text, design, and branding, is owned by Shadow in Motion and protected by intellectual‑property laws. You may not copy, resell, or redistribute it without permission. Third‑party reference materials linked from the Service belong to their respective owners.
10. Third‑Party Services
The Service relies on third parties including Stripe (payments), Supabase (accounts and data), our hosting provider, and any AI provider you choose. Your use of those services is also subject to their terms and privacy policies. We are not responsible for third‑party services.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or that any result will be achieved.
12. Limitation of Liability
To the fullest extent permitted by law, Shadow in Motion and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, arising from your use of the Service, member interactions, or meetups. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the claim.
13. Indemnification
You agree to indemnify and hold harmless Shadow in Motion from any claims, damages, or expenses arising out of your use of the Service, your content, your conduct at meetups, or your violation of these Terms.
14. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including risk, liability, and indemnification provisions) will continue to apply.
15. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict‑of‑laws rules. You agree that any dispute will be resolved in the courts located in Texas, except where applicable law provides otherwise.
